1. Permission to grant the child admittance to the BAC. I hereby request that Bronson Athletic Club allows entrance to their facility under the supervision of the undersigned designated member, of the following minor child (“Child”) of the undersigned parent or legal guardian:
2. Acknowledgement and assumption of risk of injury to the child. I understand and agree that there are risks of significant injury to the child, whether caused by the child or someone else, in their use of or presence on the BAC premises. I understand and agree that these risks of injury include, but are not limited to, slips, trips, falls, collisions, thefts, equipment failure, or other such accidents or incidents that may result in injury, harm or damage, including but not limited to economic, property, emotional, mental, physical, or any other type of damage, including but not limited to sprains, torn muscles or ligaments, broken bones, strokes, heart stress, heart attacks, paralysis, disfigurement, death, or other forms of pain or suffering. I acknowledge and agree that, while activities in the BAC are monitored generally by the BAC employees, it is not feasible for such employees to monitor the activities and actions of all members, guests or visitors at all times or all individuals simultaneously. The BAC is not responsible for the actions or activities of other guests, members or visitors using the facility or the negligence of its employees in supervising the BAC or its usage, including actions, activities, or omissions that result in such harm. On my behalf, and on the behalf of the minor child above, I fully understand, voluntarily accept, and specifically assume these risks of injury to the child.
3. Waiver liability and indemnification agreement. On my behalf, and on behalf of each of the minor children above, I agree to release and discharge from all liability, and waive all claims, demands and actions against, Bronson Athletic Club, and its owners, operators employees, agents, vendors and volunteers (collectively, Bronson Athletic Club) for any and all injuries, harms, or damages sustained by the child in connection with their use or presence on the premises, or their use of facilities, equipment, services, programs, or activities within or outside its centers, resulting or arising from the negligent acts or omissions of the Bronson Athletic Club, or the negligent acts or omissions of me, the child, other members, guests, visitors, or other persons on anyone against Bronson Athletic Club related to such injuries, harms, or damages.
4. Agreement to pay medical expenses. I acknowledge, accept, and assume the risk of any and all medical conditions, limitations, or disabilities(whether temporary or permanent) that I or the child possess, whether known or unknown, which might contribute to or exacerbate any injury I or the child might sustain as a result of using the BAC facility or any of its equipment. I acknowledge and agree that if medical assistance (of any form, including emergency care, hospitalization, out-patient care, and/or physical therapy) is required or performed as a result of any injury I or the child sustains while using the BAC facility, such assistance shall be at my own expense.
5. Behavior. I understand that management may expel any individual for violating club rules or for any conduct deemed disruptive under Bronson corporate standards, such as harassment of any kind. I acknowledge and agree that my child has a duty to exercise good judgment and act in a responsible manner and to obey the rules and policies of the BAC including but not limited to any posted and stated warnings or education signs and instructions from the BAC staff. I acknowledge and agree that, while the activities at the BAC are monitored generally by employees, it is not feasible for such employees to monitor the activities and actions of all customers at all times or all customers simultaneously.
By clicking Submit below on this agreement, I certify that I have thoroughly read, fully understand, and voluntarily accept and agree to its terms. I understand that this release and waiver applies not only to use of the equipment but any and all activities at the BAC.
Children under the age of 12 may only participate in swimming, racquetball, and/or basketball; however, adult supervision is required at all times. Children are permitted access to the Club only during the hours of operation. No one under the age of 18 may bring a guest unless accompanied by an adult.
